Contaminated Tissue

The possibility of the use of contaminated tissue in transplants is a real danger following the recent arrest of four people in New York for illegally harvesting and selling tissue.

Ordinarily people receiving donated tissue are protected by guidelines set up by the Food and Drug Administration and the Centers for Disease Control and Prevention. However, these criminals found a way to circumvent the law.

The illegal selling of unregulated and possibly contaminated tissue opens up the issue of who may be at fault in any future lawsuits.

If proper procedures are not followed then no medical precautions are taken to ensure that the tissue used for transplantation is free from contamination. It may even be difficult to determine if any contaminated tissue had been implanted in patients.

In the U.S. the transplantation of tissues including muscle, skin and bone is common. The selling of implantable body parts is legal, if conditions are met to make sure no tissue is contaminated.

Anyone suspecting that they or a loved one has been the recipient of suspect transplants should contact a lawyer experienced in contaminated tissue cases.
